- What is an N244 application?
- The standard application notice used in civil proceedings to ask the court for an order not already provided for in the timetable.
- Can a CCJ be set aside?
- Yes, in two situations: (i) as of right if the judgment was wrongly entered (CPR 13.2), or (ii) at the court's discretion if you have a real prospect of successfully defending the claim, or there is some other good reason (CPR 13.3).
- How quickly should I apply?
- Applications to set aside default judgment must be made promptly. Delay is a significant factor the court considers. Aim to file within days, not weeks, of learning of the judgment.
- What is the fee?
- The current standard fee for an N244 with notice is £275 (£137 without notice).
