Overview

How we help

An N244 is the standard application notice used to ask the court to make an order — most commonly to set aside a default judgment, extend a deadline, vary an order or apply for specific directions. We help you prepare a clear, evidenced application with the best prospects of success.

Who this is for: Litigants and businesses who need to make a specific application in existing County Court or High Court proceedings.

What is included

  • Assessment of the strength of the application
  • Preparation of Form N244 and Part C or supporting statement
  • Evidence organisation and exhibit indexing
  • Explanation of the applicable test (e.g. Denton principles for relief from sanctions, CPR 13.3 for setting aside default judgment)
  • Advice on with-notice vs without-notice applications
  • Preparation for the hearing

Process

How the process works

  1. 01

    Application review

We check whether the N244 is the right route and assess the merits.

  2. 02

    Statement and evidence

We prepare Part C or a witness statement setting out the grounds and evidence.

  3. 03

    Filing

You file the N244 with the court and pay the fee (typically £275).

  4. 04

    Hearing preparation

We help you prepare for the hearing where the court decides the application.

When we help

Common situations we help with

Every matter is different, but the following situations come up frequently. If any of these sound like yours, we can help.

  • You need to set aside a County Court Judgment (CCJ)
  • You missed a court deadline and need relief from sanctions
  • You want to vary or discharge an existing order
  • You need permission to file evidence out of time
  • You want specific directions from the court

Frequently asked

Common questions

What is an N244 application?
The standard application notice used in civil proceedings to ask the court for an order not already provided for in the timetable.
Can a CCJ be set aside?
Yes, in two situations: (i) as of right if the judgment was wrongly entered (CPR 13.2), or (ii) at the court's discretion if you have a real prospect of successfully defending the claim, or there is some other good reason (CPR 13.3).
How quickly should I apply?
Applications to set aside default judgment must be made promptly. Delay is a significant factor the court considers. Aim to file within days, not weeks, of learning of the judgment.
What is the fee?
The current standard fee for an N244 with notice is £275 (£137 without notice).
